TERMS OF SERVICE

# GENERAL
This is an agreement between me, the artist ("itsabeau"), and you ("the client"). By paying the invoice, you acknowledge and agree to these terms.# PAYMENTS AND REFUNDS
• Payment in full is required before the client may receive any final products.
• The client agrees to not chargeback the artist after the work has been completed.
• itsabeau cannot offer full refunds for commissions with progress for any reason.
• itsabeau offers partial refunds based on work completed if the deadline for the work has been exceeded by 1+ months.
• itsabeau reserves to right to use cancelled, rejected, or refunded commission sketches for other works.# REVISIONS
• For YCH work, there are no updates during the drawing process. The client will be sent the commission when it is finished, and can request minor changes (e.g. hue shift) or ask for corrections (mistakes of character details).
• Major changes requested after starting "lineart" may incur additional fees. Minor changes where itsabeau has forgotten small details in the reference (beauty marks, jewelry, etc.) will be changed at no additional charge.
• itsabeau sends updates during the following stages of work for custom commissions: rough sketch, refined sketch, lineart, final product preview. These work-in-progress updates will not be full-res images of the work.# DEADLINES AND DELIVERY
• If the client requests a rush order of fewer than 7 days from the commission request, they will be charged an additional 20% fee.
• Unless a privacy fee is paid, itsabeau may post your commission on social media and use your commission as an example for future commissions.
• The client may freely request that itsabeau does not post the work on social media until a certain date (e.g. if the commissioned work is a surprise gift, or the client would like to post the work on their social medias first) up to 2 months after the commission is completed.
• The client will receive a full-res image upon completion of commission to a provided means of communication: VGen DMs, email, social media etc.
• itsabeau can, provided no emergency computer failure, store the commissioned work on a personal computer for 12 months after the commission is completed.# USE
• The client may not use the work to produce or advertise NFTs.
• The client may not use the work to train generative AI.
• If the client has paid for monetization rights, the client may use commissioned work for Youtube thumbnails, Youtube videos, and Twitch overlays under the condition the client visibly gives credit and links to one of itsabeau's social medias or in a description box or panel OR by leaving itsabeau's signature visible and legible.
• The client is free to post commissioned artwork on any social medias with credit.
• The client may make small edits to their commission work - e.g. if parts of the design were changed after receiving the final product. If the client posts an edited version of the commission, it must be clear the work was edited.
• The client may not make major edits to non-commercial commissioned work for the purpose of cutting for Vtubing or PNGtubing.
• The client is free to use their commissioned artwork as Discord/IM/website profile pictures.# COMMUNICATION
• itsabeau can be contacted on the following social media platforms: VGen and Twitter.
• Please be upfront about your commission request. Unrelated DMs might be pinged as spam.
• Please only provide 1-2 main references for OCs. The client may provide additional reference for small details like unusual pupils, tattoos of any kind, or clothing styles.
• itsabeau may refuse to take a commission for any reason. itsabeau does not have to disclose why a commission request may be refused.
• The client must provide a means of communication to receive commission updates. This can be VGen private messages, or alternatively, an email address or social medial handle.
